If indeed this open sincerity to be fair is not exhibited, how can the inquiry being undertaken possibly lead to just decisions? When the only witnesses the majority of committee members appear willing to hear as evidence of impeachable offenses are Judge Kenneth Starr or his witnesses alone, at what point will opposing views of the law ever be presented? On Nov. 12th, Judge Leslie Light is reported to have said to the prosecutor in the McDougal/Mehta case "The penal code is not designed to take a given situation and spin it into as many felonies as possible." The judge was reinforcing this necessary premise of law upon dismissing charges against the plaintiff which only speculated wrongdoing with no factual evidence to back them up. It can be reasonably argued that the Constitution is not designed to take a given situation of Presidential misconduct and spin it into as many impeachable offenses as possible. If criminal allegations are to be proven, they must be based on all facts of the case and not presented only in extracting speculated wrongdoing out of context of the laws under the penal code. At this time it appears that the prevailing charges of impeachable offenses being levied against the President are perjury, obstruction of justice and subordination of perjury based initially on William Clinton's Jan. 17th deposition in the Jones case, as well as Monica Lewinsky's testimony. Subsequent charges of the like within the Starr investigation warrant no serious relevance if the Starr investigation was fraudulent in its legal premise. Therefore, it is of utmost necessity to first establish all true facts and evidence leading to the Starr investigation. According to the Summary Judgement by Judge Susan Webber Wright in dismissing the Paula Jones case against the private citizen, William Clinton, the Jones legal team deliberately presented a false proffer in order to justify questioning Clinton and Lewinsky on their relationship to one another. They had hoped to establish the pattern that Clinton gave job favors for sex and denied job favors for not giving sex, yet there was never any factual evidence to establish this pattern. The testimonies then given by Clinton and Lewinsky were deemed immaterial and in fact, it was proven the questions shouldn't have been asked in the first place. In addition, if William Clinton as governor of Arkansas never did anything whatsoever to tamper with the job opportunities of Paula Jones, how could he have possibly have intended to obstruct justice to her case by not disclosing all immaterial truth of his relationship to Monica Lewinsky? Of course, no legal connection was ever possible to establish, before or afterwards, between a relationship of sexual consent and an alleged encounter of sexual assault for which there was also no factual evidence. If there is any expert witness on the laws and facts of this case, how can the most informed authority of all not be Judge Susan Webber Wright? Why is she not being questioned? Why wasn't she questioned by Judge Kenneth Starr? Why has she never cited President Clinton with contempt as she reported she was considering? Why is her opinion and documentation of it being brushed aside by so many members of the Judiciary Committee? I submit that all prosecutors and upholders of the law have a duty in their efforts to prove guilt of offenders to include and fully examine any and all evidence of an exculpatory nature. Not doing so is a total waste of taxpayers dollars in undue investigation when the truth by the defense finally comes out. Though grave moral issues and private misconduct of public officials are indeed worthy of public awareness and discussion, it is not the job of the government to investigate nor question these private matters unless there is substantial factual evidence of clear criminal wrongdoing. To cross this line is to violate the Bill of Rights guarantee that the government cannot tread on the right to privacy. When respect for this amendment is lost and historical precedent is established to ignore it when Judges simply speculate, postulate or possibly even fabricate legal wrongdoing, a go-ahead signal to all of society and courts is given to pry into private affairs regardless of potential harm to innocent parties. This is an extremely serious matter to take into account during the impeachment inquiry because if Congress doesn't care about the Bill of Rights or the protection of the innocent, why should anyone else? While I seriously suspect that Judge Kenneth Starr both ignored exculpatory evidence of President Clinton and unnecessarily invaded intimate private matters of numerous witnesses in the Lewinsky investigation thereby violating the Bill of Rights, I recognize that such an investigation of the IOC must be conducted separately. However, I raise my argumentation about his methods because they cast doubt on whether or not in due fairness to the President, Judge Starr should be the only main witness on impeachable offenses. Not only is all of America watching this process, the entire world is watching as well and indeed nearly all European countries have stricter observance of privacy laws than the new disrespectful interpretations of them by the United States government. World leaders and the American people clearly exhibit more respect and support for President Clinton and trust in his credibility than the majority ruling in Congress. Will they trust the American government if the majority chooses to impeach the President in a partisan political manner on anything less than the highest possible legal standards of fairness and justice outlined in the Constitution and the Bill of Rights?
